Terms and Conditions for Tree Surgeons Wallington
These Terms and Conditions apply to all services provided by Tree Surgeons Wallington in connection with tree work, arboricultural maintenance, and related site operations. By making a booking, accepting a quotation, or allowing work to begin, the customer agrees to be bound by these terms. They are intended to set out the basis on which services are supplied, including the booking process, payment arrangements, cancellations, liability limits, waste handling, and the legal framework governing the agreement.
For the purposes of these terms, references to “we”, “us”, and “our” mean the service provider trading as Tree Surgeons Wallington, and references to “you” and “your” mean the customer, client, or person instructing the work. These terms apply to domestic and commercial customers unless a separate written contract states otherwise. If any term conflicts with a specifically signed written agreement, the signed agreement will take priority to the extent of that conflict.
Tree surgeons in Wallington may provide a wide range of services, including pruning, crown reduction, tree felling, stump work, hedge maintenance, emergency call-outs, and associated site clearance. The exact scope of work will always depend on the quotation, the site conditions, and any permissions or restrictions that may apply. You are responsible for ensuring that the work you request is lawful and suitable for the property or land involved.
A booking is usually confirmed after an enquiry has been reviewed, a quotation has been accepted, and any requested deposit or pre-authorisation has been arranged. Quotations may be based on photographs, written descriptions, site visits, or a combination of these. Where the work is straightforward, an estimate may be provided; where the circumstances are more complex, the quotation may be subject to final adjustment if additional issues are discovered before or during the work.
The booking process is only complete once we have confirmed the agreed date, the expected scope, and any special requirements. You must ensure that all relevant information is accurate before confirming the job, including access limitations, tree condition, boundary issues, underground services, parking restrictions, wildlife concerns, and any previous treatment or structural problems. If incorrect or incomplete information causes additional time, equipment, or cost, we may amend the price accordingly.
We reserve the right to refuse, defer, or reschedule a booking where weather, safety, access, legal restrictions, or operational issues make it impractical to proceed. Tree surgery can involve changing conditions, and the final decision to continue may be made by the responsible operative on site if there is a risk to people, property, or equipment.
Payment terms will be set out in the quotation or invoice. Unless otherwise agreed in writing, payment is due in full on completion of the work or within the stated payment period for account customers. We may request a deposit in advance to secure a booking, cover materials, or reserve labour. Any deposit will be specified in advance and may be non-refundable where costs have already been incurred.
We accept payment by the methods stated at the time of booking or invoicing. If payment is not made on time, we may charge interest and recover reasonable debt collection or enforcement costs where permitted by law. Title to any materials supplied as part of the service may remain with us until full payment has been received, to the extent allowed by applicable law.
Prices are normally quoted in pounds sterling and, unless stated otherwise, are exclusive of VAT. If the quotation states that VAT applies, it will be added at the prevailing rate. Tree surgeons may sometimes need to alter the price where the original quotation was based on limited information and new conditions arise, such as hidden decay, obstructed access, extra dismantling, or a change in waste volume. Any significant change should be explained before the work continues whenever reasonably possible.
Cancellations and rescheduling requests must be made as soon as possible. If you cancel after a booking has been arranged, we may retain the deposit or charge a cancellation fee to cover planning, staffing, or lost appointment time, especially where the job was reserved during a busy period. The amount retained will be fair and proportionate to our likely loss and any costs already incurred.
If you ask us to postpone a job, we will try to offer an alternative date, but this cannot always be guaranteed. Where adverse weather, unsafe site conditions, or legal concerns mean that work cannot proceed, we may cancel or defer the booking ourselves. In such cases, we will usually offer to rearrange the appointment, and any prepaid amount will be applied to the new date unless a refund is required by law.
Where access is not available, permissions have not been obtained, or the person who booked the work is not present to confirm instructions where required, we may treat the visit as a cancellation or wasted attendance. This includes situations where fences are locked, vehicles block access, the correct tree is not identifiable, or essential utilities and permits have not been arranged in advance. Any charges arising from such issues will be limited to reasonable losses.
We take reasonable care and skill in carrying out all services, but tree work involves inherent risks, including falling timber, hidden defects, underground services, and unpredictable natural behaviour. You agree that trees, branches, stumps, and related materials may behave differently from what appears visible from the ground. Our liability is limited to losses caused by our proven negligence, breach of contract, or failure to use reasonable skill and care.
We will not be responsible for pre-existing defects, structural weaknesses, or problems that were already present before the work started, including decay, root movement, subsidence, fungal infection, soil instability, or damage caused by earlier contractors. We are also not liable for indirect or consequential losses such as loss of use, loss of profit, or inconvenience, except where such exclusion is not permitted by law. Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot legally be excluded.
If we are asked to work near buildings, boundary features, glass, ornaments, driveways, utilities, or other vulnerable items, you must tell us about them before work begins. Unless we agree otherwise in writing, you remain responsible for removing or protecting fragile items, ensuring clear access, and confirming the location of hidden services. Any advice we provide about risks or precautions is given in good faith, but final responsibility for site preparation rests with the customer.
The customer is responsible for ensuring that any required permission, consent, or notice has been obtained before work starts. This may include landlord approval, neighbour agreement where relevant, tree preservation restrictions, conservation controls, or planning considerations. If work is delayed, restricted, or stopped because the necessary permission has not been secured, we may charge for any time or expenses already committed.
Tree surgery Wallington services often generate green waste, timber, woodchips, stump arisings, and other organic material. Unless agreed otherwise, we will remove and dispose of waste in accordance with applicable environmental, waste transfer, and duty-of-care requirements. Waste will be handled through lawful routes only, and we may provide records or transfer notes where appropriate. If you ask to keep logs, chips, or arisings, you are responsible for their storage, use, and onward handling once they leave our control.
We may recycle, re-use, or recover suitable organic waste where lawful and practical. Waste regulations may require segregation, documentation, and transport by authorised persons. You must not ask us to dispose of restricted, hazardous, or non-green materials unless we have expressly agreed to do so in advance and the law permits it. Any items not included in the quotation, such as soil, rubble, fencing, or domestic refuse, may be removed only by separate agreement and at additional cost.
Where the work involves chainsaws, chippers, climbing, rigging, stump equipment, or elevated access, you agree to keep children, pets, visitors, and bystanders away from the work area. You must not interfere with our operations, equipment, traffic management, or safety controls. We may stop work immediately if conditions become unsafe, if an unauthorised person enters the area, or if hidden hazards are discovered.
Any completion times stated are estimates only unless a fixed schedule is expressly agreed. Delays may occur due to weather, access problems, equipment failure, traffic, unexpected tree condition, or the need to comply with safety procedures. We will act reasonably to minimise disruption, but no guarantee is given that work will be completed on a particular day or within a specific time window if conditions prevent it.
All tools, machinery, and protective equipment remain our property at all times. You must not use, move, or interfere with them unless invited to do so by our team. If damage is caused by deliberate interference, misuse, or failure to follow site instructions, we may seek recovery of repair or replacement costs. This does not affect any rights you may have under mandatory consumer protection legislation.
Any dispute should first be raised promptly and in writing so that the issue can be investigated and, where appropriate, corrected or explained. We aim to resolve concerns fairly and efficiently. If a part of these terms is found to be invalid, unlawful, or unenforceable, the remainder will continue in full force, and the affected provision will be treated as modified only to the extent necessary to make it lawful.
These terms may be updated from time to time to reflect changes in law, industry practice, or our service arrangements. The version in force at the time of booking will apply to that specific job unless a later written variation is agreed by both parties. No waiver of any right or remedy will be effective unless we choose to enforce it in writing.
Nothing in these terms affects your statutory rights where you are a consumer. If you engage us as a business customer, you confirm that you have authority to enter into the agreement and that you will provide accurate instructions, site information, and access arrangements. Any notices required under these terms should be treated as valid if delivered by the usual written methods used for business correspondence.
The agreement between you and Tree Surgeons Wallington is governed by the laws of England and Wales. Any dispute, claim, or matter arising from or connected with these terms, the quotation, or the services supplied will be subject to the exclusive jurisdiction of the courts of England and Wales, except where consumer law provides otherwise. This governing law clause applies regardless of where the customer is based.
By proceeding with a booking, you confirm that you have read, understood, and accepted these Terms and Conditions. You also confirm that the information you have given is accurate to the best of your knowledge and that you will cooperate with reasonable safety and access requirements. These terms are intended to support a professional, transparent, and lawful service relationship for all tree surgeons in Wallington and related arboricultural services.
